1.1. The “SOYKA surprise” Platform<\/b> is an information service providing the technical infrastructure for interaction between Buyers and Artisans (Masters).<\/p>\n
1.2. Artisan (Master)<\/b> is an independent seller who receives funds for the goods directly.<\/p>\n
1.3. Buyer<\/b> is any person placing an order through the Platform.<\/p>\n
1.4. “Surprise” Order<\/b> is a service for organizing the individual selection of goods, where the final parameters are determined by the Artisan.<\/p>\n2. Agency Nature of the Transaction<\/h3>\n
2.1. The Platform (hereinafter the “Service Provider”) acts solely as an agent providing a technical platform for order processing and payment facilitation.<\/p>\n
2.2. The Platform is not a seller of goods. The purchase agreement is concluded directly between the Buyer and the Artisan at the moment of order payment.<\/p>\n
2.3. The Buyer acknowledges that the order total consists of:<\/p>\n
The price of the goods (received by the Artisan);<\/p>\n<\/li>\n
The Platform’s service fee (commission for organizing the interaction).<\/p>\n
2.4. The Platform is responsible solely for the correct operation of the service and the organization of interaction, but bears no responsibility for the manufacturing quality of the goods, which falls entirely within the scope of the Artisan’s responsibility.<\/p>\n<\/li>\n<\/ul>\n
3.1. Payment is made by the Buyer to the Platform’s bank account. The Platform, acting as an agent, transfers the funds to the Artisan less the service fee.<\/p>\n
3.2. In the event of claims regarding quality or non-performance of obligations, the Buyer shall submit the claim directly to the Artisan. The Platform undertakes to facilitate communication by providing the Buyer with the Artisan’s contact details.<\/p>\n
3.3. If the Buyer requests a refund, the Platform acts as a mediator in the settlement: the refund of the share belonging to the Artisan is executed only after the Artisan confirms the validity of the refund. The Platform’s service fee is considered a fully rendered service for organizing the transaction and is non-refundable.<\/p>\n
4.1. Within the “Surprise” format, the Buyer entrusts the choice of visual characteristics to the Artisan. Any subjective discrepancy between the final product and the Buyer’s expectations (within the selected categories) shall not constitute grounds for declaring the product defective or of poor quality.<\/p>\n
5.1. The Platform shall not be liable for any direct or indirect damages incurred by the Buyer as a result of the actions of the Artisan or third parties (e.g., courier services).<\/p>\n
5.2. Governing Law:<\/b> This Offer shall be governed by and construed in accordance with the laws of the State of Israel. All disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts of Bat Yam.<\/p>\n
5.3. The Platform processes the personal data of the Buyer solely for the purposes of executing this agreement and transfers it to the Artisan strictly to the extent necessary for the delivery of the goods.<\/p>\n
